Terms of Service
inSHADE ("inSHADE") utilizes state-of-the-art security and end-to-end encryption to provide anonymous, secure messaging, data storage, and other services to users globally. If you choose to use our website, data mesh, apps, or service (together, "Services"), you are implicitly agreeing to be bound by our Terms of Service ("Terms") .
Minimum Age. You must be at least 13 years old to use our Services, or at least the minimum age to use our Services without parental approval in the country which would have jurisdiction in determining if you have reached the age of majority.
Account Registration. Registering an account is completely anonymous and we will not collect any data from you other than your chosen username and password. Once created, you are entirely responsible for this data and neither we, NOR anyone else, can retrieve it for you.
Data Privacy. inSHADE does not share or allow access to your account data or content for our profit in any way - ever. Further, we do not employ ANY form of advertising or use any marketing software/strategies within our services that would in ANY WAY compromise the security/integrity of your communication with our services or expose your identifiable information to any third party.
Software. In order to enhance, update or strengthen security, implement stronger encryption, and enable new features or functionality, you consent to downloading and installing updates to our Services from time to time as may be necessary.
Fees and Taxes. You are responsible for any data and mobile carrier fees and taxes associated with the devices from which you access/use our Services.
Our Terms and Policies. You must use our Services according to our Terms and posted policies. If for ANY REASON we disable your account for a violation of those Terms, you will not create another account without our permission.
Legal and Acceptable Use. You agree to use our Services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our Services in ways that may violate or infringe the rights of inSHADE, our users, or others.
Harm to inSHADE. You must not (or assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorized manners, or in ways that harm inSHADE, our Services, or systems. This includes, but is not limited to not (a) gaining or trying to gain unauthorized access to our Services or systems; (b) disrupting the integrity or performance of our Services; (c) creating accounts for our Services through unauthorized or automated means; (d) collecting information about our users in any unauthorized manner; or (e) reselling, renting, or charging for our Services.
Keeping Your Account Secure. inSHADE does not have the ability to access your account OR communication data at any stage of it's lifetime within the provision of our Services or storage in our data mesh. You are solely responsible for keeping your inSHADE account data safe and secure. We accept NO liability whatsoever for a "hijacked" account and have NO WAY of verifying who the "real" owner is, therefore it is up to the user to keep their account data secure.
Third-party services. For the protection of YOUR security and anonymity, our Services NEVER interact with third-party websites, apps, or content, and never introduce your account to other products and services. Where possible, our system provides you with warning of any messages or content you may be sent that may violate your privacy or anonymity should you choose to open, interact or otherwise trigger them. An example of this would be a message containing a link to click/open. This potentially compromises your anonymity if that link exposes your ip address or other technical information. Wherever possible, we make every effort to abstract these risks and warn our users of the danger of proceeding BEFORE they can inadvertantly expose themselves.
Rights and Licenses
Your Rights. You unequivocally own ANY data and communications you submit through our Services.
inSHADE's Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our written permission . To report any suspected copyright, trademark, or other intellectual property infringement, please contact email@example.com.
inSHADE's License to You. inSHADE grants you a limited, revocable, non-exclusive, and non-transferable license to use our Services in accordance with the Terms as outlined herein.
Disclaimers and Limitations
Disclaimers. YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE PROVIDE OUR SERVICES ON AN "AS IS" BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. inSHADE DOES NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR-FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR INFORMATION (INCLUDING CONTENT) OF OUR USERS OR OTHER THIRD PARTIES. Limitation of liability. THE inSHADE PARTIES WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES, EVEN IF THE inSHADE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES WILL NOT EXCEED ONE DOLLAR ($1.00). THE FOREGOING DISCLAIMER OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. Availability of Our Services. Our Services may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time. Users will be notified of any modifications to our services at the earliest possible stage, though we reserve the right to make any immediate modifications necessary in the interest of protecting the anonymity or security of our users.
Resolving Disputes and Ending Terms
Resolving disputes. You agree to resolve any Claim you have with us relating to or arising out of our Terms, us, or our Services exclusively in the Reykjavik District Court for the Northern District of California or a state court in San Mateo County, California. You also agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such disputes. Icelandic law governs our Terms, as well as any disputes, whether in court or arbitration, which might arise between inSHADE and you, without regard to conflict of law provisions.
Ending these Terms. You may end these Terms with in SHADE at any time by "burning" your inSHADE account thereby discontinuing the use of our Services. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms or create harm, risk, or possible legal exposure for inSHADE. The following provisions will survive termination of your relationship with inSHADE: "Licenses," "Disclaimers," "Limitation of Liability," "Resolving dispute," "Availability" and "Ending these Terms," and "General".
inSHADE may update the Terms from time to time. When we update our Terms, we will update the "Last Modified" date associated with the updated Terms. Your continued use of our Services confirms your acceptance of our updated Terms and supersedes any prior Terms. You will comply with all applicable export control and trade sanctions laws. Our Terms cover the entire agreement between you and inSHADE regarding our Services. If you do not agree with our Terms, you should "burn" your account to stop using our Services.
If we fail to enforce any of our Terms, that does not mean we waive the right to enforce them. If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from our Terms and shall not affect the enforceability of the remaining provisions. Our Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. The inSHADE data mesh is designed to never collect or store any identifiable information. All communication between users is end-to-end encrypted using the strongest encryption available, and anonymity is assured using our proprietary data mesh which further encrypts, then splits the data and stores it across our global network of servers which is constantly cycling. Therefore ALL inSHADE messages and files cannot be accessed by US or ANY OTHER third parties, regardless of the circumstances, only the user/recipient..
Information You Provide
Account Information. Registering an account is completely anonymous and we will not collect any data from you other than your chosen username and password. Once created, you are entirely responsible for this data and neither we, NOR anyone else, can retrieve it for you.
Messages. inSHADE cannot decrypt or otherwise access the content of your messages or files. inSHADE stores end-to-end encrypted messages and files within its proprietary global data mesh for delivery to recipients and storage.
Additional technical information is stored on our servers, including randomly generated authentication tokens, keys, and other material that is necessary to transmit messages. inSHADE limits this additional technical information to the minimum required to operate the Services and warrants that NONE of it is usable to decrypt your data, identify a given user, or connect two users to each other.
Contacts. inSHADE never accesses your contacts or any other data on your devices, or creates any link or relationship between your personal contacts on a device and an inSHADE recipient.
User Support. All support is conducted anonymously. If it is absolutely necessary to access your profile to correct your issue, we do it by having YOU generating a one-use key DURING your support session to permit profile access. Even during this access, your file data and communication contents are still encrypted by your passphrases and CANNOT BE ACCESSED by our support personnel.
Managing your information. You can manage the very limited profile information we maintain using inSHADE's Settings menu. For example, you can update your password or choose the countries that make up your global data mesh network.

- To meet any applicable law, regulation, legal process or enforceable governmental request.
- To enforce applicable Terms, including investigation of potential violations.
- To detect, prevent, or otherwise address fraud, security, or technical issues.
- To protect against harm to the rights, property, or safety of inSHADE, our users, or the public as required or permitted by law.
